Relative to Secretary of the United States Department of Homeland Security Kristi Noem.

LEGISLATIVE COUNSEL’S DIGEST

This measure would urge Secretary of the United States Department of Homeland Security Kristi Noem to resign, and would urge the United States Congress to impeach her if she does not resign.

WHEREAS, The Secretary of the United States Department of Homeland Security holds a critical responsibility to uphold the United States Constitution, faithfully execute the laws of the United States, and protect the safety and civil liberties of the American people; and

WHEREAS, Kristi Noem has consistently failed in her duties as the Secretary of the United States Department of Homeland Security by breaking her oath to support and defend the United States Constitution; and

WHEREAS, Secretary Noem has used the power bestowed upon her to interfere with criminal investigations into the murders of Alex Pretti and Renée Good by covering up information and evidence; and

WHEREAS, Secretary Noem made false and inflammatory remarks about the nature of Renée Good and Alex Pretti’s murders that were in no way supported by any evidence; and

WHEREAS, Secretary Noem has irrevocably damaged the credibility of and the public’s faith in the United States Department of Homeland Security; and

WHEREAS, Under the leadership of Secretary Noem, the United States Department of Homeland Security has pursued policies and taken actions that have inflicted harm on vulnerable immigrant communities; and

WHEREAS, These policies and actions have eroded the due process that is guaranteed to all people in the United States, regardless of immigration status, by the United States Constitution; and

WHEREAS, These policies and actions have fostered fear among families and essential workers across the country; and

WHEREAS, The United States Congress has both the authority and the duty to conduct oversight and, when warranted, pursue impeachment to ensure accountability for high crimes and misdemeanors; and

WHEREAS, Section 4 of Article II of the United States Constitution provides that “The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors”; now, therefore, be it

Resolved by the Assembly and the Senate of the State of California, jointly, That the Legislature of the State of California urges Secretary Kristi Noem to resign for the good of the country and to avoid the divisiveness of impeachment; and be it further

Resolved, That if Secretary Kristi Noem does not resign, the Legislature of the State of California urges the United States Congress to impeach Secretary Kristi Noem; and be it further

Resolved, That the Chief Clerk of the Assembly transmit copies of this resolution to the President and Vice President of the United States, to the Speaker of the House of Representatives, to the Majority Leader of the House of Representatives, to the Minority Leader of the House of Representatives, to the Majority Leader of the United States Senate, to the Minority Leader of the United States Senate, and to each Senator and Representative from California in the Congress of the United States.
