An act to amend Sections 281.6 and 5895 of the Public Utilities Code, relating to communications.

LEGISLATIVE COUNSEL’S DIGEST
(1) Existing law vests the Public Utilities Commission with regulatory authority over public utilities, including telephone corporations. Existing law requires the commission to develop, implement, and administer the California Advanced Services Fund program to encourage deployment of high-quality advanced communications services to all Californians that will promote economic growth, job creation, and the substantial social benefits of advanced information and communications technologies. Existing law requires the commission, in collaboration with relevant state agencies and stakeholders, to maintain and update a statewide, publicly accessible, and interactive map showing the accessibility of broadband service in the state, as provided.
This bill would authorize the commission to collect information from providers of broadband services at the address level. The bill would prohibit the commission from disclosing residential subscriber information, as provided.
(2) The Digital Infrastructure and Video Competition Act of 2006 establishes a procedure for the issuance of state franchises for the provision of video service, defined to include video programming services, cable service, and open-video system service, administered by the commission. The act requires, among other things, the commission to collect granular data on the actual locations served by franchise holders.
This bill would specify that actual locations include addresses.
The people of the State of California do enact as follows:
SECTION 1.
Section 281.6 of the Public Utilities Code is amended to read:
281.6.
(a) The commission, in collaboration with relevant state agencies and stakeholders, shall maintain and update a statewide, publicly accessible, and interactive map showing the accessibility of broadband service in the state, including, but not limited to, information identifying the percentage of each census block that has broadband service meeting federal and state standards.
(b) The commission may collect from providers of broadband services information necessary to establish and update the map required pursuant to this section.
(c) The commission shall also create a notification feature on the map for individuals. Using this feature, an individual may sign up to be notified when updates are made to the map.
(d) The commission may collect information from providers of broadband services at the address level.
(e) The commission shall not disclose residential subscriber information protected by Section 2891.
(f) For the purposes of this section, “broadband” has the same meaning as defined in Section 5830.
SEC. 2.
Section 5895 of the Public Utilities Code is amended to read:
5895.
(a) The commission shall collect granular data on the actual locations served by the holder of a state franchise.
(b) The commission shall adopt customer service requirements for a holder of a state franchise and adjudicate any customer complaints.
(c) The commission shall not publicly disclose any personally identifiable information collected pursuant to this section.
(d) All information submitted to the commission pursuant to this section shall be disclosed to the public only as provided for pursuant to Section 583.
(e) For purposes of this section, “actual locations” include addresses.
